Legal Aspects of OER
When using, developing and creating Open Educational Resources (OER) you should consider some legal aspects. These include:
- Copyright: Who owns the copyrights to it, and how can these rights be preserved while at the same time making the material openly available?
- Licensing: What licensing conditions should apply to the OER material?
- Terms of use: Who may use the OER and under what conditions?
- Change: Under what conditions are users allowed to change or adapt the OER?
- Commercialisation: How can creators prevent OER materials from being used commercially without their permission?
Information on legal aspects of OER can be found here:
- “Legal framework” (German) is a page of the project OERinForm: Advice on the Creation of OER at Universities, which contains, among other things, a guide: “Offene Bildungsmaterialien in der Hochschullehre – Leitfaden zu rechtlichen Fragestellungen” (German)
- “Legal issues around OER: copyright, links and disclaimers” by hwt Saar (German)
- Dossier “Law” of the OERinfo information centre (German)

Information on licensing OER can be found here in the Open Economics Guide.
